Possession of any amount under 3 ounces is a misdemeanor, punishable by up to 1 year in jail and a $1,000 fine. Possession of 3 ounces or more is a felony, carrying up to 5 years in prison and a $10,000 fine. A second misdemeanor offense is elevated to a felony.

Penalties for Sale and Distribution

Selling, distributing, or manufacturing cannabis is a serious criminal offense in Idaho. Delivery of any amount carries up to 5 years in prison. Trafficking larger quantities can result in mandatory minimums up to 15 years and fines of $50,000.

Medical Cannabis

Idaho does not have a comprehensive medical cannabis program. The legislature has repeatedly rejected medical cannabis bills. Several Idaho cities have passed nonbinding resolutions supporting medical cannabis, but the state has not acted on them.

CBD and Hemp Products

Hemp-derived CBD is legal under HB 126 (2021), but Idaho requires products to contain no more than 0.1% THC—stricter than the federal 0.3% standard.
