Current Legal Status in Texas

Recreational cannabis is illegal in Texas with significant criminal penalties. The state has a very limited Compassionate Use Program providing access to low-THC cannabis for a narrow set of conditions.

Penalties for Possession

Possession of 2 ounces or less is a Class B misdemeanor with up to 180 days and $2,000. Two to 4 ounces is a Class A misdemeanor with up to 1 year and $4,000. Four ounces to 5 pounds is a state jail felony. Larger amounts carry up to life in prison.

Penalties for Sale and Distribution

Selling, distributing, or manufacturing cannabis is a serious criminal offense in Texas. Sale of any amount is at minimum a Class A misdemeanor. Amounts over 7 grams are felonies ranging from 2 years to life depending on quantity.

Medical Cannabis Program

Texas has an operational medical cannabis program established in 2015. The Compassionate Use Program (2015, expanded 2019 and 2021) provides access to low-THC cannabis for intractable epilepsy, seizure disorders, MS, ALS, terminal cancer, autism, and PTSD. The program remains highly restrictive compared to other states.

CBD and Hemp Products

Hemp-derived CBD products containing no more than 0.3% THC are generally legal in Texas following the 2018 federal Farm Bill. These products are available in retail stores and online.
