Recreational Cannabis Laws in New Jersey

New Jersey legalized recreational cannabis in 2020 through Public Question 1, a voter-approved constitutional amendment. Licensed retail sales began in April 2022. Adults aged 21 and older may legally purchase, possess, and consume cannabis for personal use. The state oversees a regulated cannabis industry covering cultivation, manufacturing, testing, and retail sales. New Jersey is notable for prohibiting home cultivation even for recreational users, one of only a few legal states with this restriction.

Purchase and Possession Limits

Adults can purchase up to 1 ounce of cannabis flower per transaction at a licensed dispensary, along with 5 grams of cannabis concentrate or resin. Public possession is limited to 1 ounce of flower or equivalent in other forms. At home, individuals may store up to 6 ounces in a secure location at home. Exceeding legal limits can result in civil penalties or criminal charges depending on the amount.

Home Cultivation

New Jersey does not allow home cultivation of cannabis for recreational users. All cannabis must be purchased from state-licensed retail dispensaries. Unauthorized cultivation can result in criminal charges.
